Rules, praying to pass a judgment and decree: (a)directing the defendants to pay a sum of Rs.1,69,31,438/- (Rupees One Crore Sixty Nine Lakhs Thirty One Thousand Four Hundred and Thirty Eight Only) with interest @ 24% per annum from the date of plaintiff till date of realization; (b)to create charge over the suit schedule property till realization of the suit claim as under clause (a); and (c)to pay the cost of the suit. J U D G M E N T

The learned counsel appearing for the plaintiffs and defendants 1 and 3 have reported settlement and filed a joint compromise memo to that effect. In the light of the compromise memo, the plaintiffs seek leave of this Court to dispose the suit as settled out of Court.

2. In view of the above submissions and the joint compromise memo filed by the plaintiffs and defendants 1 and 3, the suit is dismissed as settled out of Court. Consequently, the order passed in A.Nos.1835 of 2016 and 1 of 2016 have become infructuous. The plaintiffs are entitled to get refund of Court fee as per Section 69 of the Tamil Nadu Court Fees and Suit Valuation Act.
