O R D E R

It appears by a notice of enquiry bearing Rc.No.E2/6015/15 dated 02.3.2016, the very same Survey and Settlement Officer who earlier passed an order dated 27.5.2015 rejecting the claim of the petitioner, has called

the petitioner to attend an enquiry at her office on 24.3.2016. It appears that the petitioner attended the enquiry, but the officer was not available on that date. The next date of hearing has not been intimated so far. Therefore, I am of the view that for the present, it would be sufficient to direct the officer to complete the enquiry and pass final orders within a time frame.

2. Hence, this contempt petition is disposed of, directing the Survey and Settlement Officer, in the office of the Commissioner of Survey and Settlement, Chepauk, Chennai 5, to complete the enquiry after giving opportunities to the parties and pass final orders within a period of three months in the proceedings Roc.No.E2/6015/15. The Enquiry Officer shall take note of the decision of the Full Bench of this Court in The Special Commissioner and Director of Survey and Settlement v. V.Arumugam [W.A.No.326 of 2007 dated 24.7.2007] on the question of limitation, while deciding the issue.
