PRAYER: Second Appeal filed under Section 100 of the Cde of Civil Procedure, 1908 praying to set aside the Judgment and Decree passed by the Principal Subordinate Judge, Tindivanam, in A.S.No.18 of 2007 on July 30, 2009, reversing the Judgment and Decree passed by the learned Additional District Munsif of Tindivanam in O.S.No.415 of 2001 dated on November 27, 2006.

ORDER

This Second Appeal has been filed praying to set aside the judgment and decree passed by the learned Principal Subordinate Judge, Tindivanam, in A.S.No.18 of 2007 on July 30,2009, reversing the judgment and decree passed by the learned Additional District Munsif of Tindivanam in O.S.No.415 of 2001 on November 27, 2006.

2. When the matter is taken up today, Ms.G.Sudha, learned Counsel for the Appellant, submits that the matter is settled out of Court and hence she seeks permission to withdraw the Second Appeal. To that effect she has made an endorsement in the case file. Scanned reproduction of the same is as follows:

3. In view of the endorsement made by the learned Counsel for the Appellant, this Second Appeal is dismissed as withdrawn. There shall be no order as to costs.
