ORDER
This Writ Petition has been filed to call for the records of the second respondent culminating in the order dated 20.02.2024 made in Proc. No. CORP/ HR / 406/ 02/ 2023 and quash the same consequently direct the respondents to fill up the posts of Industrial Trainee. (i). Industrial Trainee (Specialised Mining Equipment (SME) Operations) (ii) Industrial Trainee (Mines and Mines Support Services) as per the provision of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 ( R and R Act 2013) and Tamil nadu Land Acquisition Laws (Revival of Operation, Amendment and validation) Act, 2019.
2. Heard Mr.R.Surendran, learned Additional Government Pleader appearing for the first respondent and Mr.N.Nithyanandam, learned counsel appearing for the second respondent.
3. The case of the petitioners is that they are Project Affected Persons (PAP) whose family lands were acquired by the second respondent for mining purposes and Award No.23/2009 dated 05.10.2009 was passed on 05.10.2009 and possession was taken. Subsequently, the second respondent issued Notification No.02/2023 dated 07.06.2023 inviting applications from Project
Affected Persons for undergoing training as Industrial Trainees. The petitioners applied pursuant to the said notification and participated in the examination conducted on 06.01.2024. Thereafter, results were published, but the names of the petitioners did not appear in the provisional selection list. Aggrieved by the same, the petitioners have filed the present Writ Petition.
4. The learned counsel for the petitioners submitted that this Court may grant liberty to the petitioners to file a separate writ petition claiming employment rights on the basis of the scheme under which the petitioners' land were acquired.
5. Considering the facts and circumstances of the case and the submission made by the learned counsel for the petitioners seeking liberty to file a separate writ petition claiming employment rights on the basis of the scheme under which the petitioners' land were acquired, this Court is inclined to grant such liberty.
6. Accordingly, this Writ Petition stands disposed of granting liberty to the petitioners to file a separate writ petition claiming employment rights on the basis of the scheme under which the petitioners' lands were acquired, in accordance with law. No Costs. Consequently, connected miscellaneous petitions are closed.
