PRAYER: This criminal miscellaneous petition has been filed under Section 528 of BNSS Act, to modify the condition imposed in Crl.O.P.No.2102 of 2025 dated 29.01.2025 as the petitioner to appear before the learned Judicial Magistrate Palladam or any other Courts in Tiruppur instead of the petitioner shall stay at Chennai and report before the Inspector of Police, B-1, North Beach Police Station, every day at 10.30 a.m., until further orders.

ORDER

The petitioner seeks modification of condition 4(b) imposed on the petitioner in Crl.O.P.No.2102 of 2025 dated 29.01.2025.

2. The learned Government Advocate (Crl.Side) submitted that the petitioner has complied with the conditions only for twenty days.

3. In response, the learned counsel for the petitioner submitted that since he has business at Palladam, Tiruppur, he is unable to stay at Chennai and report before the Inspector of Police, B-1, North Beach Police Station. 4.Considering the aforesaid facts, this Court is of the view that the condition 4(b) imposed on the petitioner in Crl.O.P.No.2102 of 2025 dated 29.01.2025 can be modified, directing the petitioner to appear before the respondent police for a period of one week and thereafter, before the Page No.2 of 4

learned Judicial Magistrate Palladam monthly once, i.e., on the first Saturday of every month @ 10.30 a.m.

5. Further, time to furnish surety is extended by a period of two weeks from the date of receipt of a copy of this order.

6. Accordingly, the criminal miscellaneous petition is ordered, and the condition is modified.
