Petition praying that in the circumstances stated therein the High Court will be pleased to extension of time to the petitioner to make payment of balance fine amount of Rs,15,00,000/- in Crl.M.P.No.1440 of 2020 in Crl.A.No.3 of 2020 dated 04.02.2020 and also pass such further or other order or orders.[CRL.MP.NO.2925/2020] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of MR.N.RAMAKRISHNAN FOR M/S.WARAON AND SAI RAMS Advocate for the petitioner and of MR.K.SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- This petitioner was granted suspension of sentence.
2. In Crl.M.P.Nos.45 and 46 of 2020 in which one of the condition was that the petitioner should deposit a sum of Rs.10,00,000/- immediately for enlargement of bail and after release of bail, the petitioner shall deposit another sum of Rs.15,00,000/- to the credit of C.C.No.3 of 2005 before the XI Additional Principal Special Court, Chennai. The fine amount of Rs.10,00,000/- was deposited and the petitioner was released on bail. The balance amount of Rs.15,00,000/- could not be mobilized immediately and Crl.M.P.No.1440/2020 was filed seeking extension of time. This Court, by order dated 04.02.2020, granted further time of four weeks. Now, the petitioner filed this petition seeking further extension of time. Now, he is ready to deposit a sum of Rs.8,00,000/- and grant him three more weeks time for depositing the balance amount of Rs.7 lakhs.
3. The learned counsel further submits that the trial Court is not accepting to receive the said Rs.8 lakhs and insisting the entire amount of Rs.15 lakhs to be paid. The petitioner is unable to mobilize Rs.15 lakhs immediately. The petitioner shall remit Rs.8 lakhs anytime and balance amount of Rs.7 lakhs within 3 weeks thereof. 4. Considering the submissions, this Court directs the trial Court to receive Rs.8 lakhs from the petitioner, being the part amount of the condition imposed by this Court, and the balance of Rs.7 lakhs shall be paid within a period of three weeks from the date of receipt of a copy of this order.
5. The petitioner shall deposit a sum of Rs.8,00,000/- on or before 12.03.2020 and the balance amount of Rs.7,00,000/- on or before 27.03.2020.
