PRAYER: The Civil Revision Petition is filed under Article 227 of the Constitution of India, prayed to set aside the fair and decretal order dated 10.03.2022 passed in E.A.No. 2 of 2022 in E.P.No. 1191 of 2013 in O.S.No.9974 of 1992 on the file of IX Assistant City Civil Court, Chennai. The Petition is filed challenging an order passed in E.A.No.2 of 2022, filed by the respondent / decree holder for recalling himself for re-examination after few weeks since the closure of his cross examination. 2.When the matter came up before this Court on the last occasion on 17.03.2022, the learned counsel for the respondent submitted that the reexamination itself is completed and it is posted for cross examination of the re-examination of P.W.1 in the Execution Petition. The learned counsel further submitted that re-examination is concluded with that one question and he has no further question. The learned counsel for the revision petitioner then took time and today he made a fair statement that not much was asked, he however submitted that he will cooperate with the Execution Court and complete the cross examination of P.W.1 at the earliest.
3.This Civil Revision petition is disposed of accordingly. Consequently, the connected C.M.P.No.4571 of 2022 is closed. No costs. 18.03.2022 dk / kas
