The petitioner who was arrested on 18.07.2020 for the offences under Section 8(C) and 20(b)(ii)(C) NDPS Act in Crime No.4616 of 2020, seeks bail.

2. It is the case of the prosecution is that the petitioner along with other accused were found in illegal possession of 250 kgs of Ganja and the same was seized by the respondent Police.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and this is the second bail petition filed by the petitioner and however, the petitioner may be permitted to file a fresh bail petition before the Trial Court, if any change of circumstances arises.

4. The learned Government Advocate (Crl. side) submitted that trial has been commenced and evidences L.W.1 to 3 have been examined. Further if the petitioner enlarged on bail, it would cause delay in the trial M.DHANDAPANI,J.

CRL.O.P.No.6407 of 2022 sk and investigation and furthermore, there is no change in circumstances for consideration, after the previous order was passed on merits. Hence, the learned Government Advocate vehemently opposed to grant bail to the petitioner.

5. In view of the submission made by the learned Government Advocate, no change of circumstances arises for considering the second bail petition . Hence, this Criminal Original petition is dismissed. However liberty is granted to the petitioner to workout his remedy in the manner known to law.
