ORDER

The civil revision petitioners are the third parties to the suit in O.S.No.6062 of 2008 on the file of the VI Assistant Judge, City Civil Court, Chennai.

2. The civil revision petitioners filed an application in I.A.No.19220 of 2012 in O.S.No.6062 of 2008 under Order I Rule 10(2) of the Code of Civil Procedure praying to implead them as parties to the suit in O.S.No.6062 of 2008.

3. The learned VI Assistant Judge, City Civil Court, Chennai vide his fair and decreetal order dated 17.01.2013, dismissed the petition. Aggrieved over the same, the present civil revision petition is filed.

4. When the civil revision petition came up for admission, no order of interim stay was granted by this court. Therefore, this court directed the Registry to ascertain whether the suit in O.S.No.6062 of 2008 is still pending on the file of the VI Assistant Judge, City Civil Court, Chennai.

5. Accordingly, a report in D.No.9216of 2019 dated 20.08.2019 was received from the I Assistant Judge, City Civil Court, Chennai in which it is stated that the suit in O.S.No.6062 of 2008 was disposed of on 11.04.2014. Therefore, nothing survives for further adjudication in this matter.

6. In the result, the civil revision petition is dismissed as infructuous. No costs. The connected miscellaneous petition is dismissed. 20.08.2019 Index : Yes/No Internet:Yes/No Speaking/Non speaking order mst To The VI Assistant Judge, City Civil Court, Chennai.
