..Respondents Writ petition is filed under Article 226 of Constitution of India, praying for issuance of writ of certiorarified mandamus, to call for the entire records in pursuant to the impugned order dated 08.05.2015 in Proc.No.P2/26422/2014 on the file of 2nd respondent, quash the same and consequently direct the 2nd respondent to restore the original position of the petitioner seniority with all attendant benefits.

The captioned writ petition has been filed for issuing a writ of certiorarified mandamus assailing the order dated 08.05.2015 issued by the second respondent and to direct the second respondent to restore the original position of the petitioner's seniority with all attendant benefits.

By the impugned order, the name of the petitioner in the revised temporary panel list of ACTO 2010 was deleted and the petitioner included in the temporary panel list of DCTO 2011 at SL.No.74A/2011. However, the petitioner's contention is that the place of petitioner's name in the DCTO list of 2011 is below his junior namely the third respondent herein, though he was appointed subsequently as Assistant and was also below in the ACTO temporary list 2010.

Learned counsel for the respondents has placed on record of the proceedings dated 27.11.2023 issued by the Commissioner of Commercial Taxes in relation to revised panels drawn for the year 2000 to 2023 and in the said proceedings, the petitioner's name has been included in the DCTO list 2012, above his juniors. Following the proceedings dated 27.11.2023 inter se seniority list of Deputy Commissioner Tax Officer for the year, from 1981 to 2022 is published and in the said inter se seniority list, the petitioner has been placed above his juniors.
4. In the light of the subsequent proceedings, the relief sought for in this writ petition does not survive for adjudication at present.
5. Accordingly, this Writ Petition is disposed of. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs. 01-08-2025 Index : Yes/No AT 3/4
