A.No.205 of 2017 had been filed to reopen the evidence of PW.1 in order to file additional document, namely, agreement of sale dated 25.4.2008. This court heard the learned counsel for the Respondent/ Defendant also. With observation granting necessary opportunity to cross examine the witness on the document produced, this application is allowed.

2. A.No.204 of 2017 had been filed to recall PW.1 to adduce further evidence. Since A.No.205 of 2017 is allowed and the evidence on the side of the Plaintiff is reopened, PW.1 has to be recalled to give further evidence with respect to the document now sought to be marked and accordingly, PW.1 is directed to appear before the Additional Master I on 6.2.2017 to give further evidence and to be cross examined by the Respondent/ Defendant on the same day. Accordingly, A.No.204 of the 2017 is allowed.

3. A.No.206 of 2017 had been filed to receive the sale agreement dated 25.4.2008 as additional document. Since A.Nos.205 and 204 of 2017 to reopen the evidence of PW.1 and to recall PW.1 have been allowed, A.No.206 of 2017 is allowed, however, the said document has to be marked subject to admissibility, proof and relevancy.
