ORDER

Mr.S.Arumugham has come to this Court complaining noncompliance of the order passed by this Court. The learned counsel appearing for the petitioner stated that when the sister of the petitioner, who was in employment as a teacher, got married on 14.6.98 and got separated from the petitioner's family, the petitioner is entitled to get compassionate appointment.

2. But this Court is unable to find any merit in the prayer for compassionate appointment, for the following reasons. Firstly, when the father of the petitioner died on 30.10.96, admittedly, the sister of the petitioner was in employment as a teacher and therefore, on the date of death, the family was not in indigent circumstances. Secondly, the petitioner's family was also receiving family pension. Thirdly, the sister of the petitioner was supporting the family for a period of 1 1⁄2 years and only after her marriage on 14.6.98 living separately, has rendered the family situation into indigent circumstances, for which the respondent-Department cannot be held responsible. Although it is claimed that the said order was set aside, this Court is not convinced to accept the prayer of the petitioner 2/3

for compassionate appointment. Therefore, the contempt petition stands closed.
