ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, directing the respondents herein to consider the petitioner's representation dated 02.02.2026 to remove the 4th respondent from the post of Anganwadi Worker, Maniyampattu, Bajanai Kovil Street, Vellore District on the ground of Suppression of Materials facts at the time of appointment.

2. With the consent of the learned counsel appearing on either side, this Writ Petition is taken up for disposal at the admission stage.

The learned counsel appearing for the petitioner would submit that the petitioner married one Sathish Kumar on 12.09.1999 as per Hindu Rites and Customs and no children were born out of the said wedlock. During the subsistence of the said marriage, the petitioner's husband developed an illicit relationship with the 4th respondent, who was already married and had two children. Subsequently, two children were born through the 4th respondent to the petitioner's husband. Thereafter, the petitioner's husband died on 09.05.2021. However, the 4th respondent obtained a job as Anganwadi worker

by suppressing her marriage on the basis of destitute widow in the year 2012. For removing the 4th respondent from the post of Anganwadi Worker, the petitioner has also made a representation dated 02.02.2026 to the respondents. Since no order was passed, the present writ petition is filed with the above said prayer.

4. The learned counsel appearing for the petitioner would submit that this Court may issue a direction to the respondents to consider the petitioner's representation and pass appropriate orders within a specified time.

Per contra, learned Government Advocate appearing for the respondents would submit that the petitioner claim that there was an illegal relationship between the petitioner's husband and the 4th respondent and further claim that prior to that, the 4th respondent performed the marriage. Subsequently, the 4th respondent, who is a destitute widow obtained appointment as Anganwadi Worker on 05.09.2012 whereas the petitioner made a representation in the year 2025 as if the 4th respondent obtained employment by suppressing the marriage and seeking to cancel the appointment however, no proof was filed before this Court and appointment order was challenged after lapse of 13 years by way of mandamus is not sustainable one. Accordingly, he prayed for dismissal of the writ petition.

6. The facts of the present case is not in dispute. Though the petitioner claim that the 4th respondent obtained employment by suppressing the marriage however, no proof was filed before this Court and appointment order was challenged after lapse of 13 years is not sustainable one.

7. In view of the above discussion, this Writ Petition is dismissed. No costs.
