C.M.P. Nos.7407, 7410 and 7412 of 2024 have been filed by the petitioners i) to condone the delay of 260 days in filing the petition to set aside the abatement caused due to the death of the sole appellant; ii) to set aside the abatement caused due to the death of the sole appellant and iii) to bring on record the legal representatives of the deceased sole appellant as appellants 2 and 3 in the above main appeal.

2. Heard Mr.R. Subramanian, learned counsel for the petitioners.

3. The learned counsel for the 2nd respondent has stated no objection for allowing these applications.

4.This Court is satisfied with the reasons contained in the affidavit filed in support of these petitions as sufficient cause has been shown. Accordingly, these petitions are allowed. 1/3

5. Registry is directed to carry out necessary amendments and post the Second Appeal on 21.06.2024.
