RAJAMANICKAM CRIMINAL MISCELLANEOUS PETITION No.2936 of 2020 IN CRL.R.C.No.154 of 2019 C.NALLATHAMBI [ PETITIONER ] Vs P.JAYAKUMAR [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition of bail imposed on the petitioner in Crl.M.P.No.1355/2019 in Crl.R.C.No.154/2019 dated 29.01.2019 to direct the petitioner to report before the Trial Court on the first working day of every month 10.30 am pending disposal of the Crl.R.C.No.154 of 2019.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.V.BHIMAN, Advocate for the petitioner, and of M/S.P.V.SANJEEV, Advocate, on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition of bail imposed by this Court in Crl.MP.No.1355 of 2019 dated 29.01.2019.
2. This Court while suspending the sentence which was imposed by the trial court and the same was confirmed by the appellate court, has directed the petitioner has directed to appear before the trial court on the first working day of every month at 10.30 a.m pending disposal of the revision. To relax the said condition, the present petition has been filed.
3. It is seen from the records that already the petitioner has filed a similar type of petition in Crl.MP.8993 of 2019 and the same was dismissed by this court on 10.07.2019, however, a liberty was given to the petitioner to file an application under Section 317 of Cr.P.C, if the petitioner is not able to appear on any particular day and appear before the Magistrate on any other day as determined by the Magistrate in lieu of the day on which the petitioner is https://hcservices.ecourts.gov.in/hcservices/
absent. Therefore, this Court does not find any merits in this petition.
