ORDER

The petitioner, who was arrested and remanded to judicial custody on 06.01.2026, for the alleged offence punishable under Sections 126(2), 296(b), 309(4), 311, 351(3) of BNS Act 2023 in Crime No.25 of 2026 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he along with other accused approached the defacto complainant who is auto driver and with a knife point robbed a sum of Rs.1,870/- and threatened him with dire consequences. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner has been in incarceration since 06.01.2026, and he has been falsely implicated since he was having some previous cases and is ready to co-operate with the investigation. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate(Ctrl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is having 8 previous cases of similar nature and it is not a false case foisted against the petitioner and if the petitioner is granted bail there is likelihood that he will indulge in similar offences. Hence, he opposed for grant

of bail to the petitioner.

5. Considering the fact that it is a case of robbery at knife point and the petitioner is also having 8 previous cases and if the petitioner is granted bail there likelihood that he will indulge in similar offences, hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
