ORDER

This petition has been filed seeking a direction to the Respondents to revise the pay scale of difference in leave Salary and different in Gratuity as per

15th wage settlement dated 29.05.2025 along with interest at the rate of 10% to the petitioners.

2.The case of the petitioners is that they joined the service of the 1st respondent Corporation as Drivers in 1995 and rendered nearly 28-34 years of continuous service. At the time of retirement, they were holding the post of Senior Special Grade Driver, having served in various depots of the Corporation. The petitioners retired during 2023-2024. The 15th wage settlement was belatedly arrived at on 29.05.2025, but the wage revision was given effect from 01.09.2023. Since the petitioners were in service on 01.09.2023, they are entitled to the benefits of the settlement. However, their terminal benefits were settled on the basis of the pre-revised pay instead of the revised pay. On the other hand, their pension was revised in March 2024 based on the revised basic pay.

It is pertinent to point out that, as a consequence of the 15th wage revision, the difference in salary, leave salary, gratuity, and pension has not been settled to date, though the petitioners are entitled to the same. The petitioners submitted representations requesting payment of interest for the belated settlement, but the respondents have neither replied nor extended the 15th settlement benefits to them. Hence, claiming the difference in gratuity and leave salary, the present writ petition has been filed.

3.The learned counsel for the petitioners would submit that it would suffice, if a direction is issued to the respondents to consider the petitioners' representation dated 05.02.2026, 06.02.2026 and 10.02.2026 within a reasonable time to be fixed by this Court.

4.Considering the limited request made by the learned counsel for the petitioners, this Court, without going into the merits of the case, directs the respondents to consider the petitioners' representations dated 05.02.2026, 06.02.2026 and 10.02.2026 and to pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
