O R D E R
The relief sought for in the present writ petition is to direct the respondents to cancel the registration of sale deed dated 16.11.2011 registered as document No.7388 of 2011.
2. The relief as such sought for in the present writ petition is absolutely misconceived. Such a relief to cancel the sale deed cannot be cancelled in a writ proceeding under Article 226 of the Constitution of India.
3. It is brought to the notice of this Court that the land was acquired for public purposes under the Land Acquisition Act and other litigations are pending. Though the petitioner states that the acquisition proceeding is lapsed, the said submission was objected by the Housing Board on the ground that the writ appeal is pending.
4. May that as it be, it is left open for the parties to workout the remedy in the manner known to law. As far as the present writ petition is concerned, the direction as such sought for to cancel the registration of sale deed cannot be considered even at the time of filing of the writ petition. There is no provision under the Registration Act. That being the factum, the petitioner is at liberty to workout the remedy in the manner known to law.
