This application is filed seeking to condone the delay of 74 days in filing the written statement filed by the defendant.

2. According to the applicant, he received suit summons on 22.02.2022 and due to misplacement of certain material papers, he could not file the written statement in time and the same was filed only on 06.06.2022 with the delay of 74 days in filing the written statement.

3. It is asserted by the applicant that the delay in filing the written statement is not wanton and it was due to the bonafide reasons stated in the affidavit.

4. Having satisfied with the reasons assigned in the affidavit, this application is allowed.
