HEMALATHA CRP.NPD.NOS.874 AND 875 OF 2013 1 A.ATHIAMMAL [ PETITIONERS IN BOTH THE PETITIONS ] 2 A.MAHALINGAM Vs A.RAJA MANICKAM [ RESPONDENT IN CRP(NPD).874/13] V.KANNAN [ RESPONDENT IN CRP(NPD).875/13 ] (i) Petitions Under Section 115 of C.P.C against the fair and decreetal order in E.P.No.41 of 2010 in O.S.No.220/2004 dated 29.01.2013 passed by the learned Sub ordinate Judge at Tambaram (in CRP.NPD.No.874/13)and;
(ii) against the fair and decreetal order in E.P.No.61 of 2010 in O.S.No.2221/2004 dated 29.01.2013 passed by the learned Sub ordinate Judge at Tambaram (in CRP.NPD.No.875/13)respectively. Order : These petitions coming on for orders upon perusing the petitions and the respective affidavits filed in support thereof and upon hearing the arguments of M/S.ABDUL MUBEEN, Advocate for the petitioner in both the petitions the court made the following order:- A perusal of the entire records shows that the petition and connected orders in the E.P.No.41 of 2010 and 61 of 2010 in O.S.No.220 of 2004 on the file of the Subordinate Judge, Tambaram have been sent to this court. It is further seen from the records that that an order of interim stay was granted only till 20.03.2013 by this court and subsequently, the order of interim stay was not extended.
2. Therefore, the Registry is directed to send the records back to the concerned court through speed post for passing further orders in E.P.No.41 of 2010 and E.P.No.61 of 2010. Since the Execution Petitions are pending for a long time, the concerned court is directed to dispose of the execution petition, within a period of 4 weeks from the date of receipt of the records from this court.
