Prayer in W.P. No. 10289 of 2021:Writ of Mandamus directing the respondent to comply with the undertaking given by the respondent in his letter No.Na Ka E11/ 17820/ 2012 dated 12.06.2019 without further delay and release the amount of Rs.96,108/- withheld from the petitioners retirement benefits with penal interest in view of inordinate and unexplained delay in releasing the amount after the orders of this Court dated 12.04.2017 made in W.P.No. 26983 of 2012 For Appellant ::

The writ appeal is directed against the order dated dated 24.11.2021 passed in W.P. No. 10289 of 2021.

When the matter is taken up for hearing, Mr. Prashanth , learned counsel (Enrolment No.2330/2-19, Mobile No:9444211474, 9176386997), representing Mr.S. Venkataraman would submit that the respondent/writ petitioner has consented to accept a sum of Rs.15,000/- towards full and final settlement of all the claims due to him, with regard to the issue in question.

On the other hand, Mr.Sundaravadivelu, learned counsel appearing on behalf of Mr. C. Selvaraj, learned counsel for the Corporation would submit that not even a pie is due to the writ petitioner. However, taking note of the suggestion made by this Court, the Corporation is willing to pay the amount and that this should not be treated as a precedent.

The above submission made by the learned counsel on either side is hereby recorded and the Corporation is expected to release the amount to the respondent/writ petitioner or before 10.06.2022. The writ appeal is disposed of accordingly. No costs. Connected C.M.P. is closed.
