Prayer: Criminal Original Petition filed under Section 482 of Cr.P.C., pleased to direct the first and second respondents to consider the petitioner representation letter dated 19.02.2022 in accordance with law and further directing the first and second respondents to give police protection to the petitioner and his property in Survey Nos.220/3F and 220/4 in Annamangalam Village, Villupuram District.

ORDER

Mr.V.Meganathan, learned Government Advocate takes notice on behalf of the first and second respondents. 2.This Criminal Original Petition has been filed seeking for a direction to the first and second respondents, to consider the petitioner representation letter dated 19.02.2022 in accordance with law and further direct the first and second respondents to give police protection to the petitioner and his property in Survey Nos.220/3F and 220/4 in Annamangalam Village, Villupuram District.

3.The learned counsel for the petitioner would submit that the petitioner is entitled to pluck the riped Tamarind from the Tamarind tree whereas, every year during the season, the third respondent is continuously causing trouble to the petitioner. 4.The learned counsel for the petitioner would further submit that the petitioner has also given a representation to the respondents seeking for police protection. However, since no action was taken, the present petition has been filed. 5.The learned Government Advocate (Criminal side) for the first and second respondents would submit that similar incidents had happened during the earlier years and two cases in Crime.Nos.407 of 2021 & 79 of 2022 have been registered against the third respondent, based on the complaint given by the petitioner. The learned Government Advocate would further submit that in Crime No.407 of 2021, the investigation was completed and the final report is made ready.

6.Taking into consideration the fact that the third respondent is alleged to have continuously harassed the petitioner every year during the season in order to prevent the petitioner from collecting ripe tamarind, the second respondent is directed to enquire into the matter and give appropriate protection to the petitioner.

7. With the above direction and observation, this Criminal Original Petition stands closed.
