GINGEE VILLUPURAM, DISTRICT.

CR.NO.13 OF 2015 Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed in Crl.M.P.No.7559 of 2017 in C.A.No.325 of 2017 dated 04.07.2017 that the petitioner shall report before the trial court once in every month on the first working day at 10.30 am.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of MR.B.MOHAN FOR M/S.M.DEVARAJ Advocate for the petitioner and of MR.K.MATHAN Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- The petitioner was granted bail by this court in Crl.M.P.No.7559 of 2017 dated 04.07.2017, by suspending the substantive sentence, subject to the condition that he shall report before the Trial Court, once in a week on every Monday at 10.30 a.m., until further orders. Now, the petitioner has filed this petition to relax the said condition.

2. The learned counsel appearing for the petitioner would submit that the petitioner is working at Chennai and inview of the condition imposed, he finds it very difficult to report for his duty at Chennai and therefore, he prayed for relaxation of the condition.

3. The learned Government Advocate (Crl. Side) has not raised any serious objection.

4. Having regard to the difficulties expressed by the petitioner, I am inclined to relax the condition in toto.

5. In the result, the Criminal Miscellaneous petition is allowed and the condition imposed on the petitioner in Crl.M.P.No.7559 of 2017 dated 04.07.2017 is totally relaxed.
