By consent the writ petition is taken up for final disposal. 2.The claim of the petitioner is that his grandfather late Venkatasamy Chettiyar owned lands and some of the lands were given to "Poondi Reservoir Lake" and the remaining lands at Survey No.504/4 in Poondi village which are housesites were enjoyed by his grandfather
and after his demise, the records were mutated in favour of the petitioner's father Balaiah Chetty and after his demise it got mutated with the petitioner's grandfather's brother's wife Tmt.Jayamma. The son of Jayamma, after her demise settled the entire property in favour of his wife Kamatchi and based on which some sale transactions took place. The grievance expressed by the petitioner is that on the above sale transactions, one Shanmugam son of Ponnappa Mudali is witness and he with an ulterior motive adopted modus operandi to grab the property taking advantage of the fact that the petitioner is a resident of Chennai. In this regard, the petitioner has made a complaint/ representation dated 14.12.2012 to the first respondent in the form of a legal notice and the second respondent has also called the petitioner for personal hearing on 22.04.2013 and he has also attended the same and thereafter, he has not been favoured with any response, and hence came forward to file this writ petition.
3.Learned counsel appearing for the petitioner has drawn the attention of this Court to the order dated 13.01.2015 made in W.P.Nos.698 and 699 of 2015 and the order dated 26.02.2015 made in W.P.No.5119 of 2015 and would submit that in the light of the said orders, appropriate directions may be issued to the second respondent to consider the complaint in terms of Sections 82 and 83 of the Registration Act after putting on notice to the first respondent and prays for disposal.
4.Heard the submissions of Mr.P.Kannan Kumar, learned counsel appearing for the petitioner and Mrs.P.Rajalakshmi, learned Government Advocate who accepts notice for the respondents. 5.This Court without going into the merits of the complaint/ representation, directs the second respondent to dispose of the petitioner's complaint/ representation dated 14.12.2012, in terms of Sections 82 and 83 of the Registration Act, after putting on notice to the persons concerned and pass orders in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision to the petitioner as well as to the persons concerned.
