[Order of the Court was made by S.S.SUNDAR, J.] This Criminal Miscellaneous Petition is filed to suspend the sentence imposed upon the petitioners/A1& A2 vide judgment dated 25.01.2023 in S.C.No.32 of 2019, passed by the learned learned Additional District and Sessions Judge, Namakkal.
2. Heard the learned counsel on either side.
3. This Court finds that the injured witness [PW1] is also an eyewitness. The evidence of PW1, is corroborated by the evidence of PW4 and PW6, who are also eyewitnesses.
4. Having regard to the nature of the offence and the involvement of the petitioners/A1 & A2, this Court does not find any prima facie case to suspend the sentence imposed upon them. Hence, this Criminal Miscellaneous Petition is dismissed.
5. Registry is directed to post the main appeal in the 2nd week of February 2024.
