ORDER
This writ petition has been filed seeking to direct the 1st respondent to consider petitioner's representation dated 06.11.2019 and thereby to permit the petitioner to receive the entire matured amount in the Policy No. 710943730 dated 21.07.1992.
2.Learned counsel for the petitioner would submit that the petitioner is the wife of late M.Mohan, who has invested in Jeevan Mitra (Double Cover) Endowment Plan in Policy No.710943730. After his demise, the petitioner made a representation before the 2nd respondent claiming the accumulated amount of insurance in the aforesaid policy. Since the same was not considered, the present writ petition has been filed.
3.Learned counsel appearing for the respondents would submit that on 07.11.2019 and 27.11.2019, the replies were sent to the petitioner directing the petitioner to produce the legal heir certificate. According to the respondent, the petitioner has not produced the legal heir certificate till date. If the same is produced, the respondent will consider the petitioner's representation.
4.Considering the submissions made by the learned counsel for the petitioner as well as the learned counsel appearing for the respondents, the petitioner is directed to produce the legal heir certificate as requested by the 2nd respondent. Since the petitioner is widow and a mother of two minor children, immediately upon the production of the legal heir certificate, the 2nd respondent is directed to release the amount. In case, if there is any nominee, 1/4th share of the amount shall be retained for the nominee and the balance 3/4th share shall be disposed to the petitioner.
