ORDER

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 419,468,471, 420 r/w 34 of of IPC, in Crime No.47 of 2017, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution as per the defacto complainant is that the petitioner has agreed to pay a sum of Rs.2,00,000/- on receiving the original title deeds as a collateral security. After receiving the original title deeds the petitioner has paid only Rs.20,000/- and failed to pay the balance amount. On suspicion, the defacto complainant applied for encumbrance certificate, which shows that the petitioner herein had created a forged power of attorney in his favour and transferred the property in his name. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Additional Public Prosecutor submitted that the petitioner along with other accused persons have created a forged power of attorney in the name of the petitioner. Hence, he prays for dismissal of this petition.

5. Considering the fact that the petitioner has involved in serious offencs and the petitioner is a habitual offender, this Court is not inclined to grant anticipatory bail to the petitioner.
