This petition has been filed to condone the delay of 60 days in filing the above appeal.

2.Mr.P.Ezhil Nilavan, learned counsel appears for the 2nd respondent.

3.Paper publication was effected on the 1st Respondent and proof for the same also filed. Even though his name is printed in the cause list, no one represented on behalf of the 1st Respondent. Therefore, the first Respondent is set exparte.

4.Having satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 60 days is condoned.

5.This Petition is ordered, accordingly.

6.Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission.

7.Registry is further directed to print the name of the respondents counsel in the cause list, at the time of admission.
