The instant writ petition has been filed with a prayer for issuing a mandamus to direct the respondents to consider the representation dated 23.01.2025 of the petitioner and to transfer her from Tirunelveli Medical College Hospital to Coimbatore Medical College Hospital in the available MS vacant seat.
2. Heard the learned counsel for both sides and perused the materials available on record.

3. The learned counsel for the petitioner would submit that she is now pursuing her MS General Surgery at Tirunelveli Medical College and Hospital, Tirunelveli, through NEET Post Graduate Admission. He would further submit that the petitioner is now in her final year and, due to medical reasons, she needs to be at Coimbatore. He would also submit that there is one seat vacant at Coimbatore Medical College for MS General Surgery.

The above submission was strongly objected to by the learned Special Counsel appearing for the first respondent, who submitted that according to the National Medical Commission guidelines, no migration is permitted, and apart from that, the question of vacancy of one seat at Coimbatore Medical College and Hospital is against the factual position. If there is no admission to the seat after the cut-off date, the said seat would get lapse. Therefore, the possibility of migration is practically, as well as according to the rules, not possible. It is the further submission of the learned Special Counsel that the academic year comes to an end in October 2025. I am in full agreement with the above submission. 3/5
5. In such view of the matter, this Court finds no merits in this Writ Petition. Accordingly, this Writ Petition is dismissed. No costs. 23.06.2025 kv Index : Yes/No Speaking order /Non Speaking Order To
