The learned counsel for the petitioner submits that the petitioner is no more.

2.The learned Additional Public Prosecutor confirms the said fact and has also produced the proceedings of the Chief Judicial Magistrate, Vellore nominating the Judicial Magistrate -II to conduct an magisterial enquiry u/s.176(1-A) Cr.P.C. to enquire into the cause of the death of the appellant in the prison.

3.In view of the aforesaid submission, the Criminal Appeal stands abated and hence, is dismissed as abated.
