ORDER
This Writ Petition has been filed to direct respondents 2 and 3 to survey, demarcate and put-up wire fencing for the property, morefully described in the prayer to this writ petition, which according to the petitioner is owned by him, based on his online application, dated 08.05.2025 with the assistance of the fifth respondent.
2.The petitioner had submitted an application through on-line on 08.05.2025 for the aforesaid purpose. Since the same has not been considered till date, the petitioner has filed this writ petition. 3.Mr.R.P.Murugan Raja, learned Government Advocate accepts notice on behalf of respondents 1 to 4. Mr.R.Venkatesa Perumal, learned Government Advocate (Crl.Side) accepts notice on behalf of the fifth respondent.
4.With regard to the prayer sought for in this writ petition, namely for putting up wire fencing with the assistance of the fifth respondent, the same cannot be granted by this Court through this writ petition and if at all the same can be redressed only through a civil suit.
5.No prejudice would be caused to any of the respondents, if respondents 2 and 3 are directed to survey and demarcate the boundaries of the petitioner's property, morefully described in the prayer to this writ petition, after hearing the objections, if any, from the neighbouring land owners and any other party as they deem it fit to enquire, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, respondents 2 and 3 are directed to issue notice to the neighbouring land owners and also any other party whom they deem it fit to put on notice.
(b) After receiving objections if any and after considering the same, respondents 2 and 3 shall conduct survey and demarcate the boundaries of the property, morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of 12
weeks from the date of receipt of a copy of this order. (c) If the need arises for police assistance and on a request made by respondents 2 and 3, the fifth respondent shall render police assistance for the effective implementation of this order.
No costs.
