By consent, the writ petition is taken up for final disposal. 2.The present writ petition has been filed seeking a Mandamus directing the respondents to issue patta in favour of petitioner in respect of the land in Survey No.485/2A of 15, Parvatghanahalli Village, PennagaramTaluk, based on the petitioner's representation dated 23.03.2016.
3.In the petition it has been stated that the petitioner is a farmer and agriculturist by avocation. He is in possession and enjoyment of 40 cents of land in Survey No.485/2A in Patta No.2139 of Paranthanahalli Village and he is cultivating the said land for the past 30 years. The said land is a punja land and the petitioner is cultivating corn in the said land. It is further stated that the respondents have recognized his possession by entering his name and details of the cultivation in the Adangal https://hcservices.ecourts.gov.in/hcservices/
Register and the respondents are also collecting taxes. The petitioner has also paid taxes upto fasali 1425 which is upto the year 2016. Since, he is in continuous possession, he submitted a representation dated 23.03.2016 for issuance of patta and also brought to the notice of the respondents his long possession and the entry in the Chitta Adangal Register. But, it has not been considered so far. Hence, the petitioner has come forward with this petition.
4.Heard the submissions of the learned counsel appearing for the petitioner and the learned Special Government Pleader. 5.Considering the submissions made on either side, this Court directs the second respondent to consider the representation of the petitioner dated 23.03.2016 with regard to issuance of patta and pass appropriate orders, on merits and in accordance with law, after affording opportunity of personal hearing to the petitioner as well as to all the necessary parties within a period of twelve weeks from the date of receipt of a copy of this order. 6.The writ petition is disposed of accordingly.
