This Second Appeal coming on for hearing on this day upon perusing the Grounds of Appeal, the judgment and decree of the Lower Appellate court and the court of First instance and the material papers in the suit and upon hearing the arguments of Mr.P.Paramasivadoss, Advocate for the Appellants, and of Mr.V.Anand, Advocate for the Respondent, this Court doth order and decree as follows:
1. that the judgment and decree dated 10.08.2011 made in A.S.No.37 of 2010 by the Additional District and Sessions court (Fast Track Court-III), Virdhachalam confirming the judgment and decree dated 16.02.2010 made in O.S.No.34 of 2009 by the subordinate court, Neyveli be and hereby are confirmed and this Second Appeal is dismissed.
2.that the Appellant/Defendant do pay a sum of Rs.10/- (Rupees Ten only) to the Respondent/Plaintiff being the cost incurred in this Second Appeal.
