ORDER

The petitioner, who was arrested and remanded to judicial custody on 17.01.2026 for the alleged offence punishable under Sections 4(1)(A) and 4(1) (C) of Tamil Nadu Prohibition (Amendment) Act, 2024 in Crime No.38 of 2026, registered on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioner is that she was found in possession of 30 bottles of spurious liquor, each containing 180 ml. Hence, a case has been registered and the petitioner was arrested.

3. The learned counsel appearing for the petitioner submitted that the petitioner is a lady and has been falsely implicated, on account of previous cases against her. He further submitted that she is in judicial custody since 17.01.2026 and that she is ready to co-operate with the investigation. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is a habitual offender and is involved in 30 previous cases pending against her and that the investigation is still pending. Hence, he opposed to grant bail to the petitioner.

5. Considering the nature of the allegations and the fact that the petitioner has bad antecedents, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 20.02.2026 drl 2/4
