ORDER : The Court Made the following order :- The petitioner, who was arrested on 30.12.2020 and remanded to judicial custody for the alleged offences punishable under Sections 6 & 17 of POCSO Act, 2012, in Crime No.20 of 2020 on the file of the respondent police, seeks bail.

2. This is the second bail application filed before this Court. The case of the prosecution is that the petitioner is arrayed as A2. Further, A1 in this case intoxicated the victim girl, who is 17 years old and A2 Sexually assaulted her, when she was in intoxicated mood. Based on the complaint given by the mother of the victim girl, the case came to be registered. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the alleged offences and he has been falsely implicated in this case. He further submits that the petitioner has been jail from 30.12.2020. Hence he prays for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate (Crl.Side) submitted that earlier application was dismissed by this Court in Crl.O.P.No.2224 of 2021 dated 24.02.2021, there is no change of circumstances. Hence, he vehemently opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that earlier application was dismissed by this Court and there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.
