Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition that the petitioner shall report before the trial court on the first working day of every month at 10.30 a.m. pending disposal of the appeal imposed by this Hon'ble court in Crl.MP.No.1/2013 in Crl.A.No.712/2013 dated 30.10.2013. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.S.RAMACHANDRAN, Advocate for the petitioner and of K.SRINIVASAN, Special Public Prosecutor for CBI Cases on behalf of the Respondent the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner by the order of this Court vide order in Crl.M.P.No.1 of 2013 in Crl.A.No.

712 of 2013 dated 30.10.2013 "that the petitioner shall report before the trial Court on the first working day of every month at 10.30 a.m., pending disposal of the appeal". 2.The learned counsel appearing for the petitioner would submit that the petitioner is resident of Bangalore and he is a octogenarian. He would submit that the petitioner had been complying with the conditions regularly from the year December 2013. Thereafter, since the Courts were closed on account of Covid-19 pandemic and the petitioner was unable to appear before the trial Court during the period between March 2020 to January 2021 and thereafter, the petitioner was infected with Covid.

petitioner was suffering from post Covid complications, he was unable to appear before the Court during the months of February 2021 and March 2021. Hence, he would pray that the absence of the petitioner's appearance during the said periods before the trial Court may be condoned. He would further submit that taking into consideration the age and health condition of the petitioner, the condition imposed on him may be modified and that the petitioner undertakes to appear before the respondent as and when required by them. 3.The learned Special Public Prosecutor(CBI Cases) appearing for the respondent would submit that he has no objection in modifying the conditions imposed on the petitioner.

4.Taking into consideration the above facts and submissions, the condition imposed on the petitioner by the order of this Court, dated 30.10.2013 in Crl.M.P.No.1 of 2013 in Crl.A.No.712 of 2013 is modified to that the effect that the petitioner shall appear before the respondent (*) CBI's office at Bangalore viz. CBI/BSFC/ Bangalore at No.36, Bellary Road, Ganganagar, Bangalore 560 032, once in three months and appear before the trial Court once in six months on the 1st working day of the particular month at 10.30 a.m. commencing from the month of June 2021, until further orders. -sd/- 26/03/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
