..Respondent(s) Writ petition is filed under Article 226 of the Constitution of India seeking for issuance of a writ of mandamus to direct the respondents to survey the lands in S.No.291/2, 292/1B, 292/2A2A having total extent of 60 cents at Erumpalayam Village, Salem Taluk, Salem District as per registered Sale deed dated 22.05.1982, registered as document No.2620/1982 on the file of Sub Registrar, Joint -1, Salem West SRO by considering the application made on 13.03.2025 and 25.03.2025 within a stipulated period fixed by this Court. ORDER
This writ petition has been filed seeking for a direction to the first respondent to survey and demarcate the property, which according to the petitioner is owned by him, within a time frame to be fixed by this Court.
2. The petitioner has also enclosed a copy of the sale deed dated 22.05.1982, by which, he became owner of the subject property. He has also enclosed a copy of the patta for the subject property. The petitioner had submitted a representation dated 13.03.2025 seeking for survey and demarcation of the property morefully described in the prayer to this writ petition. Since the said representation has not been considered till date, the petitioner has filed this writ petition.
3. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents.
4. No prejudice will be caused to the first respondent, if the aforesaid representation of the petitioner is considered, on merits and in accordance with law, after hearing the objections if any from the neighbouring land owners as well as any other party whom the first respondent deems it fit to enquire. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the land in question, the first
respondent is directed to issue notice to the neighbouring land owners, and also to any other party, whom the first respondent deems it fit to enquire.
(b) After receiving objections if any and after considering the same, the first respondent shall conduct survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
(c) If any need arises, the first respondent is permitted to submit a petition for police assistance, and upon receipt of such request, the concerned jurisdictional police shall render necessary police assistance for conducting survey and demarcation of the subject property.
