This Transfer Civil Miscellaneous Petition is filed seeking to withdraw the H.M.O.P.No.116 of 2025 from the file of the IV Additional Family Court, Chennai and transfer the same to the Subordinate Court at Virudhunagar.
2. The petitioner-wife filed H.M.O.P.No.263 of 2024 on the file of the Subordinate Court, Viridhunagar for divorce. The respondent-husband filed H.MO.P.No.116 of 2025 on the file of the IV Additional Family Court at Chennai for restitution of conjugal rights.
3. The petitioner-wife would submit that she is residing with her parents along with her son at Virudhunagar. Being a woman, it is very difficult for her to travel alone for every hearing from Virudhunagar to Chennai which is approximately 540 kms away from her residence. Hence, she sought for transfer. 2/4
4. Heard the learned counsel for the petitioner and the learned counsel for the respondent and perused the materials available on record.
5. Taking into consideration the facts and circumstances of the case and looking into the grievances expressed by the petitioner, this Transfer Civil Miscellaneous Petition is allowed and the H.M.O.P.No.116 of 2025 pending on the file of the IV Additional Family Court, Chennai is withdrawn and transferred to the file of the Subordinate Court, Virudhunagar. No costs. Consequently, connected miscellaneous petition is closed.
