ORDER

Challenging the impugned order passed in I.A.No.2 of 2025 in O.S.No.3455 of 2018 by the learned XVI Assistant Judge, City Civil Court, Chennai, the Revision Petitioner/plaintiff had preferred this Civil Revision Petition.

Before the trial court, the respondents/defendants have filed an application in I.A.No. 2 of 2025 under Order VIII Rule 1(A) of C.P.C. praying to receive the additional documents and another application filed under Order 18 Rule 17 of C.P.C. praying to recall D.W.1 for further examination. Both applications were allowed by the trial judge. Aggrieved over that, the Revision Petitioner/plaintiff preferred this Civil Revision Petition. 3.The learned counsel for Revision Petitioner/plaintiff has pointed out that during the cross-examination, D.W.1 admits that already he has handed over the documents to his counsel, but no documents was marked on his side and after closure of cross-examination, now they came forward with the said

applications to receive additional documents and to recall D.W.1, which is not maintainable. But, without considering the same, the trial judge had allowed the applications. Hence, he prayed to set aside the findings of trial judge. 4.The learned counsel for respondents/defendants appeared and submitted that the show cause notice dated 04.04.2018 issued to the plaintiff and other documents viz., resolution dated 13.05.2018 passed in the General body meeting and Resolution dated 12.05.2018 passed in the Executive Meeting were not filed at the time of filing written statement, since those documents relating to the meeting of the union and the same has to be filed only with the consent of the Union members and some of documents were found recently. So, there is a delay arose and the trial judge also rightly allowed the applications. Hence, he prayed to dismiss this Civil Revision Petition.

5. Heard and considered rival submissions made on either side and perused the materials available on record.

6.Considering both side submissions, the fact reveals that the suit was filed in the year 2018 by the revision petitioner/plaintiff for the relief of declaration to declare the removal notice issued, which is under challenge. Now, the respondents/defendants have contested the case and they wanted to produce the resolution passed in the General body meeting as well as in the Executive

Meeting and the show cause notice issued to the revision petitioner/plaintiff. If opportunity is not given to them, their valuable right to defend the case will be defeated. Therefore, liberty is granted to the revision petitioner/plaintiff to make cross-examination before the trial court with regard to those documents, otherwise it will lead to multiplicity of proceedings. With that liberty, this Civil Revision Petition is disposed of. No costs. Consequently, connected civil miscellaneous petition is closed.
