Writ Petition filed under Article 226 of the Constitution of India, praying for the issue of a Writ of mandamus to direct the respondent to correct her date of birth as 25.06.1984 instead of 25.06.1985 in her passport bearing No.R4775581 issue dated 26.10.2017 based on the application dated 25.01.2018 made by the petitioner within a reasonable time. The petitioner seeks for a mandamus directing the respondent to correct her date of birth as 25.06.1984 instead of 25.06.1985 in her passport bearing No.R4775581 issue dated 26.10.2017 based on her application dated 13.12.2017. 2.The grievance of the petitioner is that the said request is not considered by the respondent so far.

3. On the other hand, the learned counsel for the respondent submitted that the application for change of date of birth in the passport has to be made only in the proper format and not by way of representation, as has been done in this case. https://hcservices.ecourts.gov.in/hcservices/

Therefore, he submitted that only when an application is made in a proper format, the same will be considered and orders will be passed in accordance with law.

4. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the respondent to consider and decide. However, as it is stated that such request for date of birth has to be made through proper application, it is open to the petitioner to make such application before the respondent and if any such application is made in the proper format, the same will be considered and appropriate orders will be passed by the respondent on merits and in accordance with law within a period of four weeks from the date of receipt of such application from the petitioner. The writ petition is disposed of accordingly.
