Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.S.KOLANDASAMY, Advocate for the petitioner and of M/S.L.P.SHANMUGA SUNDARAM Special Government Pleader for the Respondents the court made the following order:- This petition has been filed to extend the time of conditions to comply in W.M.P.No.7249 of 2017 in WP No.6705 of 2017 dated 20.03.2017.
2. The leaned counsel for the petitioner would submit that the petitioner has complied with the conditional order of Rs.50,000/- within the time stipulated by this Court. However, due to the reasons stated in the affidavit, the petitioner is not in a position to deposit a sum of Rs.1,00,000/- on or before 30.04.2017, and other condition to deposit a sum of Rs.1,50,000/-on or before 30.05.2017. Therefore, the learned counsel requested further time to deposit the balance amount of Rs.1,00,000/- and Rs.1,50,000/-.
3. Considering the request stated in the affidavit, this Court is inclined to extend the time for payment of the balance amount, which is as follows:-
1. The petitioner is directed to deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) to the credit of the respondentsSociety's account on or before 20.06.2017.
2. Thereafter, the balance amount of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand only) to the credit of the respondentsSociety's account on or before 30.07.2017. If any default is committed by the petitioner in the above said conditions, the interim order granted by this Court would stand automatically vacated, the respondents-Society shall proceed the sale auction in accordance with law.
