The petitioner/A4 seeks anticipatory bail in Crime No.27 of 2024 registered by the respondent Police for the offences punishable under Sections 147, 148, 341, 294(b), 323, 324, 506(2) r/w 34 of IPC, with respect to an occurrence took place on 02.02.2024.

2. The defacto complainant is a student of Presidency College. The accused are students of New College, Chennai. The petitioner is studying B.Sc.(Arabic).

3. It is stated that the accused had beaten the defacto complainant with stones and knife. He was taken into hospital for treatment.

4. The learned counsel for the petitioner stated that the petitioner is innocent of the offences. But he is named in the F.I.R. The entire incident had happened to exercise the right to travel as the leader of the bus route and to be recognized as a leader among the students in the bus route.

5. However, taking all the other factors into consideration this 1/4

Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date on which the order copy made ready, before the II Metropolitan Magistrate, Egmore Court, Chennai - 600 008, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further condition that: [a] the petitioner and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.

[b] the petitioner shall report before the respondent police everyday at 10.30 a.m., for a period of two weeks and thereafter, as and when required for interrogation. [c] Additionally, the II Metropolitan Magistrate, 2/4

Egmore, Chennai may inform the Principal of New College, Chennai about registration of F.I.R. in Crime No.27 of 2024 as against the petitioner herein who is the second year student of B.Sc.(Arabics), i.e., Nasurudeen, Male, 18, S/o.Ameen, No.4 B, SM Nagar Pallavan Salai, Anna Road, Chennai - 600 002 and the said details may be noted in the records of the college. It must also be mentioned in the certificates issued by the college.

[d] the petitioner shall not tamper with evidence or witness either during investigation or trial.

[e] the petitioner shall not abscond either during investigation or trial.

[f] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 229A IPC.
