O R D E R
(Order of the Court was made by S.S. SUNDAR, J.) This Contempt Petition is filed alleging willful disobedience of the order in W.A.No.1861 of 2023, dated 23.01.2024. 2.The contempt petitioner has also filed an application in Sub Application (OS) No.832 of 2024 for issuing a direction to the respondents to allow the petitioner to peruse the entire file pertaining to the enquiry conducted by the then Deputy Superintendent of Police Mr.Gunasekharan, SBCID, comprising the original report of the then Deputy Superintendent of Police Mr.Gunasekharan, along with relevant Annexures produced during the course of enquiry.
3.It is the case of the petitioner that this Court, even at the time of disposal of the Writ Appeal, opined that cases were foisted against the petitioner under the influence of a senior Police Officer. However, the petitioner appears to be surprised by seeing the report which was furnished
to her pursuant to the directions of this Court. It is the specific case of the petitioner that the report furnished to her is tampered. After receiving the report, the petitioner has filed the application. 4.This Court is not hearing the original writ petition in which the petitioner challenged the enquiry report. The petitioner has some apprehension that the report might have been tampered. If that is so, the remedy of petitioner is elsewhere and not in the Contempt Petition where the scope is limited to examine whether the order of this Court has been complied with or not. In the Writ Appeal, this Court only directed the Public Information Officer to supply a copy of the report within a period of time. It is now admitted before this Court that the 3rd respondent has supplied a copy of the report to the petitioner, as per the directions of this Court in the order dated 23.01.2024 in W.A.No.1861 of 2023. Even though there is some delay in complying with the direction of this Court, this Court finds no willful disobedience.
5.Hence, recording the fact that the order of this Court dated 23.01.2024 in W.A.No.1861 of 2023 is complied with, this Contempt Petition is closed. Connected sub-application is also closed.
