Respondents in both WPs Common Prayer: Writ Petitions filed under Article 226 of the Constitution of India seeking a writ of mandamus to direct the respondents 1 and 2 to forthwith consider the claim of the petitioners for appointment as Cook by duly taking into consideration of the earlier services rendered as well as the seniority in the Employment Exchange apart from merits. For petitioners : Mr.L.Chandrakumar For Respondents : Mr.T.M.Pappiah, Spl.GP COMMON ORDER The petitioners seek a direction to respondents 1 and 2 to forthwith consider their claim for appointment as Cook, by taking into consideration their earlier services rendered in the second respondent office as Sweeper.
2. The second respondent issued a Notification, dated 18.03.2017, calling for Applications from eligible candidates for the post of Cook. The petitioners, who are presently https://hcservices.ecourts.gov.in/hcservices/
working as Sweeper in the second respondent office, applied for the said post.
3. Now, the only grievance of the learned counsel for the petitioners is that the petitioners' five years services rendered in the second respondent office will have to be taken into account while considering their candidature for the post of Cook.
4. However, it is brought to the notice of this Court that the second respondent has already conducted the interview on 27.04.2017, in which, the petitioners also took part, therefore, the petitioners, having taken part in the interview held on 27.04.2017, cannot seek a prayer for a direction to the respondents to count their past services rendered in the second respondent office as Sweeper. Thus, on this score, the writ petitions are liable to be dismissed and accordingly, they are dismissed. No Costs.
