ORDER

This Civil Revision Petition has been filed seeking to set aside the order passed on 21.11.2025 in IA No. 1 of 2025 in COS No. 951 of 2024 on the file of the Commercial Court (Senior Civil Judge Cadre), Coimbatore and to allow the Said Petition seeking to direct the respondent/defendant to furnish security with respect of suit claim, failure thereof, order attachment before the judgment of petition mentioned property. Upon hearing both sides, the Trial Court dismissed the said application holding that there is nothing on record to show that the respondent is about to transfer the property with an intention to delay or defeat the petitioner's claim as the property.

2. The learned counsel for the petitioner submits that the respondent is making arrangement to disposes the suit property. If the respondent sold the property, the petitioner cannot realise the decree if he won. 3.

Heard the submission of the learned counsel for the petitioner.

4. Considering that if the respondent disposes of the suit property, the petitioner will be unable to realise the fruits of the decree, the respondent is hereby directed to furnish surety before the Trial Court in respect of the suit property within eight weeks, thereafter the Trial Court proceed with I.A No.1 of 2025. Accordingly, this Civil Revision Petition is disposed of. No Costs. Pending petition, if any, is/are closed.
