ORDER
The petitioner seeks transfer of MC.No.9 of 2025 pending on the file of the Judicial Magistrate No.II, Virudhunagar, to the file of the Principal Family Court, Chennai.
2. The learned counsel for the petitioners submitted that the 1st petitioner / wife has two children and finds it difficult to travel from Chennai to Virudhunagar, is more than 500 kms. Hence, she seeks transfer of the case to the Principal Family Court, Chennai. The respondent is also employed at Guindy Mines and Minerals. Therefore, transfer of the case would not cause any prejudice to the respondent.
3. Considering the submissions made by the learned counsel for the petitioners, this Court finds the reasons stated to be justifiable and is inclined to allow the transfer.
4. Accordingly, MC.No.9 of 2025 pending on the file of the Judicial Magistrate No.II, Virudhunagar, is withdrawn and transferred to the file of the Principal
Family Court, Chennai.
5. The Judicial Magistrate No.II, Virudhunagar, is directed to transmit the case records to the Principal Family Court, Chennai, within a period of three weeks from the date of receipt of a copy of this order.
6. Upon receipt of the records, the Principal Family Court, Chennai, shall issue notice to the respondent and thereafter proceed with the matter in accordance with law and dispose of the same as expeditiously as possible, preferably within a period of three months from the date of receipt of the case records.
7. Accordingly, this Transfer Civil Miscellaneous Petition is allowed. No costs.
