This application has been filed seeking permission to the second applicant/second defendant to recall DW1 to file his proof affidavit and to give oral evidence on behalf of the applicants/defendants in the suit.

2. The learned counsel appearing on both sides would submit that they would co-operate to complete the evidence of the second defendant on or before 02.04.2026.

3. Considering the submission made on both sides and being satisfied with the reasons stated in the affidavit filed in support of this application, the second respondent is directed to adduce the evidence and the cross examination shall also be completed on or before 02.04.2026.
