Petitioner has come up with this Writ Petition seeking a direction to the 1st Respondent to disburse 25% retirement Gratuity withheld by the Respondent at the time of superannuation on 01.02.2000, with interest @ the rate of 12%. 2.
Today, when the matter is taken up for hearing, learned counsel appearing for the Respondent/Corporation produced a communication 25.07.2019 vide Na.Ka.No.B6/14574/2019 of the Assistant Commissioner, Corporation of Chennai, and https://hcservices.ecourts.gov.in/hcservices/
stated that the Respondent/Corporation is willing to disburse 25% of the Petitioner's Gratuity amount retained by them. 3.
Recording the said submission of the learned counsel for the Respondent/Corporation and the communication dated 25.07.2019, this Court is of the view that no further orders are required in this Writ Petition. However, as the employee has approached the Court belatedly, the Respondent/Corporation is directed to pay 25% of the Gratuity amount retained by them to the Petitioner, together with interest at 10% per annum from the date of filing the Writ Petition, within a period of 45 days from the date of receipt of a copy of this order. The Writ Petition is disposed of with the above direction. No costs.
