Rajasekar v. The State Rep. By Its
Crl.O.P(MD).No.5456 of 2019 R.SUBRAMANIAN,J.
The petitioner seeks anticipatory bail since he was arrayed as second accused in FIR No.63 of 2019 registered by the respondent police. The FIR was registered on the basis of the report of the Special Sub-Inspector of Police, under Sections 143, 291, 353, 506(i), 171(H) IPC, 4A(1b) r/w.4B of Tamil Nadu Open Places (Prevention of Disfigurement) Act, 1959.
2. According to the complainant the petitioner had parked his car in haphazard manner disturbing the traffic. When the same was questioned by the defacto complainant, the petitioner and his accomplice have threatened the defacto complainant and prevented them from discharging their duties.
3. On instruction, the learned Government Advocate (Crl. side) would submit that the petitioner is a history sheeter involved in
nearly 22 cases in Mukkudal and Suthamalli Police Station limits. The details of the cases have also been listed.
4. A perusal of the Sections under which the petitioner has been charged earlier shows that the offences attributed are not of very serious nature. Taking into account the fact that the offences complained are said to have been taken place during the election campaign, I am of the considered opinion that the petitioner should be granted anticipatory bail.
5. Hence, this petition is allowed and the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date of receipt of a copy of the order, before the learned Judicial Magistrate, Cheranmahadevi, on condition that the petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, as the case may be.
