Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records of the fourth respondent, thereby terminating the petitioner from service with effect from 24.07.2023 and quash the same and consequently directing the 1 to 4 respondents to reinstate the petitioner from service with all other attendant service and monetary benefits. ORDER
This Writ Petition has been filed challenging the order of termination dated 24.07.2023.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner was appointed as an Accountant under the livelihood enhancements and access to financial and other services scheme. The objectives of the Mission is to build strong and vibrant institutional platforms for the poor which would enable them to increase 2/4
household incomes through livelihood enhancements and access to financial and other services. In the resolution passed by the Panchayat, she was appointed as an Accountant. Now, by an order of termination, her engagement was discontinued on the allegation that she failed to do her duty, she had acted against the Scheme. That apart, the petitioner was not appointed in any regular sanctioned post. Only on the Panchayat Board under the particular Scheme, the petitioner was engaged to do the account work. The petitioner was engaged on daily wage basis.
4. Therefore, this Court finds no infirmity or illegality in the order passed by the fourth respondent. Accordingly, this Writ Petition stands dismissed. Consequently, connected miscellaneous petitions are closed. No costs.
